2. Scope

These Terms and Conditions apply to all contracts, services and activities of SEAFRONT PROPERTIES MALLORCA S.L. (hereinafter “SEAFRONT PROPERTIES”) towards customers, interested parties and clients.
Deviating conditions shall not apply unless expressly confirmed in writing.

3. Activity as a Real Estate Agency

SEAFRONT PROPERTIES acts exclusively as a real estate broker and intermediary.
The activity includes in particular:

  • Proof and/or mediation of real estate
  • Transfer of property information
  • Support in communication between contractual parties

An economic success (e.g. purchase, sale, rental, financing) is not owed.

4. No Obligation to Review or Advise

SEAFRONT PROPERTIES assumes no obligation to carry out legal, structural, tax or technical reviews of properties.
In particular, no liability is assumed for:

  • Building permits, usage rights, habitability certificates
  • Land register or cadastral entries
  • Area, dimensions, year of construction or equipment details
  • Construction condition, defects, contamination or value development

The client is obliged to verify all information independently or through experts.

5. Property Information & Exposés

All property information is based on information provided by third parties (owners, developers, authorities).
They are non-binding and do not represent guaranteed characteristics.
Changes, prior sale or rental remain reserved.

6. Liability

SEAFRONT PROPERTIES is only liable in cases of intent or gross negligence.
Liability for:

  • slight negligence
  • loss of profit
  • consequential damages
  • financial losses
  • missing approvals

is excluded to the extent permitted by law.
Liability is limited to a maximum of the brokerage commission paid.

7. New Builds & Development Projects

For new construction projects, off-plan properties or developer projects, SEAFRONT PROPERTIES assumes no liability for:

  • completion
  • construction quality
  • construction deadlines
  • developer guarantees
  • economic viability

8. Confidentiality

All documents, exposés and information are confidential.
Disclosure to third parties is prohibited and may trigger a commission claim.

9. Commission & Circumvention Protection

A commission claim arises as soon as a contract is concluded due to the activity of SEAFRONT PROPERTIES – including:

  • contracts concluded via third parties or related persons
  • contracts concluded at a later point in time
  • economically equivalent transactions

10. Data Protection

The following Privacy Policy applies in accordance with the GDPR.

11. Applicable Law & Jurisdiction

Spanish law shall apply.
Place of jurisdiction, insofar as legally permissible, is Palma de Mallorca.

12. Severability Clause

Should any provision be or become invalid, the remaining provisions shall remain unaffected.
